These Terms and Conditions ("Terms") govern your access to and use of electricphotoland.co (the "Site") and the products and services offered by Cone Ventures LLC dba Electric Photoland ("Electric Photoland," "we," "us," or "our"). By using the Site, submitting an inquiry, booking a session, or purchasing a product or service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or our services.

2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to book services, make purchases, or create an account. By using the Site, you represent that you meet this requirement.
3. Services and Products
Electric Photoland offers photography services, photo experiences, digital and print products, and related merchandise. Specific deliverables, pricing, timelines, and usage rights are described on the Site or in a separate booking agreement, invoice, or contract ("Booking Agreement"). In the event of a conflict between these Terms and a signed Booking Agreement, the Booking Agreement controls for that engagement.
4. Inquiries and Bookings
When you submit an inquiry, request a quote, or book a session through the Site, by email, by phone, or by text, the information you provide is stored in our systems so we can respond to you and manage your booking. Submitting an inquiry does not guarantee availability; a session or service is confirmed only when we send you a written confirmation and (where required) a signed Booking Agreement and/or deposit is received.
5. Pricing, Payment, and Taxes
- Prices are shown in U.S. dollars and are subject to change without notice until an order or Booking Agreement is confirmed.
- A non-refundable retainer or deposit may be required to hold a session date.
- You authorize us to charge the payment method you provide for the amounts due.
- You are responsible for all applicable taxes, including Washington state and local sales taxes.
- If payment fails or is reversed, we may suspend services and withhold delivery of files or products until the balance is paid.
6. Cancellations, Rescheduling, and Refunds
Cancellation, rescheduling, and refund terms are set out on the Site or in your Booking Agreement. Unless otherwise stated in writing: retainers and deposits are non-refundable; digital products and delivered files are non-refundable; and rescheduling is subject to availability. Contact smile@electricphotoland.co with questions about your specific order or booking.
7. Shipping and Delivery
Physical products are shipped to the address you provide. Risk of loss transfers to you upon delivery to the carrier. Delivery timelines are estimates and are not guaranteed. Digital files are delivered through the method described on the Site or in your Booking Agreement.
8. Client Content and Model Releases
If you appear in, submit, or upload content (including photos, videos, likenesses, or text) to us or through the Site, you represent that you have all necessary rights, permissions, and releases for that content, and you grant us a non-exclusive license to use it to perform the services you have requested.
9. Intellectual Property and Image Use
- All images, videos, designs, and other content created by Electric Photoland are the intellectual property of Electric Photoland and are protected by U.S. copyright law.
- Upon full payment, clients typically receive a personal-use license to the delivered files as described in the Booking Agreement. Commercial use, resale, alteration of watermarks, or removal of copyright notices is not permitted without a separate written license.
- Unless you opt out in writing before your session, you grant Electric Photoland a perpetual, royalty-free license to use images and footage from your session for our portfolio, website, social media, marketing, advertising, blog posts, and submissions to publications.
- All Site content (logos, text, graphics, code) is owned by Electric Photoland or its licensors. You may not copy, reproduce, distribute, or create derivative works from Site content without our written permission.
10. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms;
- Attempt to gain unauthorized access to the Site, accounts, or systems;
- Upload or transmit viruses, malware, or other harmful code;
- Scrape, data-mine, or copy the Site or its content;
- Harass, threaten, or harm our staff, clients, or other users; or
- Impersonate any person or misrepresent your affiliation with any person or entity.
11. Studio and On-Location Conduct
You agree to follow all safety rules, staff instructions, and venue or studio policies during your session. We reserve the right to end a session without refund if a client or guest behaves in a way that is unsafe, abusive, destructive, or unlawful.
12. Communications with Us
By providing your email address or phone number, you consent to receive communications from us related to your inquiry, booking, order, or account, which may include emails, phone calls, and text messages. See our Privacy Policy for details on our communications and SMS programs. You can opt out of marketing communications at any time; transactional messages related to an active order or booking may continue.
13. Third-Party Links and Services
The Site may link to or integrate with third-party services (such as Shopify, payment processors, and social media platforms). We are not responsible for the content, policies, or practices of third parties.
14. Disclaimer of Warranties
The Site and our services are provided "as is" and "as available." To the maximum extent permitted by law, Electric Photoland disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses.
15. Limitation of Liability
To the maximum extent permitted by law, Electric Photoland and its owners, officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or in connection with your use of the Site or our services. In any event, our total aggregate liability arising out of or relating to the Site, our services, or these Terms will not exceed the greater of (a) the amount you paid us for the specific service or product giving rise to the claim in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100).
Nothing in these Terms limits liability that cannot be limited under applicable law.
16. Indemnification
You agree to defend, indemnify, and hold harmless Electric Photoland and its owners, officers, employees, and contractors from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Site or services, (b) your violation of these Terms, (c) your violation of any third-party right, including any right of publicity, privacy, or intellectual property, or (d) content you submit to us.
17. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Spokane County, Washington, and you consent to personal jurisdiction and venue there.
18. Changes to These Terms
We may update these Terms from time to time. Changes become effective when posted on this page, and we will update the "Last Updated" date. Your continued use of the Site or services after changes are posted means you accept the revised Terms.
19. Severability; Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy and any applicable Booking Agreement or order confirmation, are the entire agreement between you and Electric Photoland regarding the Site and our services.
