When you submit an inquiry through our website, email, phone, or social media, we store your contact details and the content of your inquiry in our customer relationship management (CRM) and booking systems. We retain this information so we can respond to you, follow up about your project or session, keep a history of our communications, and improve our services. Inquiry records may be retained indefinitely unless you request deletion (see Section 9).
2.3 Information Collected Automatically
When you visit the Site, certain information is collected automatically, including:
- Device and browser information (IP address, browser type, operating system, device identifiers)
- Usage information (pages viewed, links clicked, time on Site, referring URLs, search terms)
- Location information derived from your IP address (general geographic area only)
- Cookies, pixels, and similar tracking technologies
2.4 Google Analytics
We use Google Analytics, a web analytics service provided by Google LLC, to help us understand how visitors use the Site. Google Analytics uses cookies and similar technologies to collect information such as the pages you visit, how you arrived at the Site, how long you stay, what device and browser you use, and your general geographic location (based on anonymized IP address).
This information is processed by Google on our behalf and is used to compile reports about Site activity, measure marketing performance, and improve the user experience. Google may use the collected data in accordance with its own privacy policy, available at https://policies.google.com/privacy.
You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on, available at https://tools.google.com/dlpage/gaoptout, or by disabling cookies in your browser settings.
2.5 Cookies and Similar Technologies
We and our service providers (including Shopify and Google) use cookies, web beacons, pixels, and similar technologies to operate the Site, remember your preferences, measure performance, and support marketing. You can control cookies through your browser settings, but disabling cookies may affect how the Site works for you.
2.6 Information from Third Parties
We may receive information about you from third parties, including payment processors, shipping providers, social media platforms, advertising networks, and Shopify (our e-commerce platform).
3. How We Use Your Information
We use the information we collect to:
- Respond to inquiries, book sessions, and provide photography and related services
- Process transactions, deliver orders, and send receipts
- Send appointment confirmations, reminders, and service-related messages
- Send marketing emails and text messages (with your consent where required)
- Follow up with you about inquiries or incomplete bookings
- Operate, maintain, secure, and improve the Site and our services
- Measure the performance of our marketing and content
- Prevent fraud and enforce our Terms and Conditions
- Comply with legal obligations
4. Email and Text Message Communications
4.1 Email Communications
When you submit an inquiry, place an order, create an account, or subscribe to our list, we may send you transactional emails (such as booking confirmations, receipts, and service updates) and marketing emails (such as promotions, newsletters, and event announcements). You can unsubscribe from marketing emails at any time by clicking the "unsubscribe" link in any marketing email or by emailing us at smile@electricphotoland.co. Transactional emails are not subject to unsubscribe and will continue so long as you have an active order or booking.
4.2 SMS / Text Messaging Program
Electric Photoland operates three categories of SMS communications, each requiring separate consent:
(a) Transactional texts. If you provide your mobile number when booking a session, placing an order, or creating an account, we may send you booking confirmations, appointment reminders, shipping and order updates, and other service-related texts necessary to complete the service you requested.
(b) Inquiry and lead follow-up texts. If you submit an inquiry form or request a quote, and you provide your mobile number, we may text you to follow up on your inquiry, answer questions, and help you book. By providing your mobile number on an inquiry form, you consent to receive these follow-up texts from Electric Photoland.
(c) Marketing texts. We send promotional texts (sales, events, new offerings) only to customers who have separately opted in by checking a consent box, texting a keyword to our number, or otherwise expressly agreeing to receive marketing texts.
Program terms (all SMS categories):
- Message frequency varies.
- Message and data rates may apply from your mobile carrier.
- Text HELP to our number for help, or email smile@electricphotoland.co.
- Text STOP to any of our text messages to unsubscribe from that category of messages. You will receive a confirmation text, after which we will stop sending messages in that category. You may continue to receive other categories of messages (for example, stopping marketing texts does not cancel transactional texts for an active order).
- We do not share mobile opt-in data or phone numbers collected for SMS purposes with third parties for their marketing, and we do not sell mobile numbers. Service providers who help us deliver text messages (such as our SMS platform and carriers) may process your number only to send our messages.
- Carriers are not liable for delayed or undelivered messages.
Our SMS practices are intended to comply with the Telephone Consumer Protection Act (TCPA) and CTIA guidelines. Your consent to receive texts is not a condition of purchasing any goods or services.
4.3 Phone Calls
We may call you at the phone number you provide about your inquiry, booking, or order. We do not make prerecorded or autodialed marketing calls without prior express written consent.
5. How We Share Information
We do not sell your personal information. We share information only as described below:
- Service providers. We share information with vendors that help us operate our business, including Shopify (e-commerce), Google (analytics and advertising), our email and SMS platforms, our CRM and booking systems, payment processors, shipping carriers, print labs, and cloud storage providers. These providers are authorized to use your information only to perform services for us.
- Legal and safety. We may disclose information to comply with the law, respond to legal process, protect our rights or the rights of others, or investigate fraud or misuse.
- Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, your information may be transferred as part of that transaction.
- With your direction. We share information with other parties when you ask us to (for example, delivering digital files to a designated recipient).
6. Advertising
We may use advertising partners (including Google and social media platforms) to serve ads about our services on other sites you visit. These partners may use cookies and pixels to measure ad performance and show you more relevant ads. You can learn about and opt out of interest-based advertising at optout.aboutads.info and optout.networkadvertising.org.
7. Data Retention
We retain personal information for as long as needed to provide our services, maintain business records, resolve disputes, and comply with legal obligations. Inquiry and customer records are generally retained for the life of the customer relationship and for a reasonable period afterward. Image files delivered to clients are retained according to our current archive policy, which is subject to change; we recommend clients download and back up their files promptly.
8. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information. However, no system is completely secure, and we cannot guarantee the security of information transmitted to or from the Site.
9. Your Choices and Rights
- Access, correction, deletion. You can request access to, correction of, or deletion of your personal information by emailing smile@electricphotoland.co. We will respond consistent with applicable law. Some information must be retained for legal, tax, or business purposes.
- Email. Unsubscribe from marketing emails via the link in any email or by emailing us.
- SMS. Reply STOP to any text to unsubscribe from that category.
- Cookies and analytics. Use your browser settings to manage cookies, and use the Google Analytics opt-out add-on to opt out of Google Analytics.
- Do Not Track. Our Site does not currently respond to "Do Not Track" browser signals.
