Employee Text Message (SMS) Consent and Acknowledgment

1. Purpose

As part of your employment with Cone Ventures LLC dba Electric Photoland ("Electric Photoland," "we," "us," or "our"), we may need to communicate with you quickly about work matters by text message (SMS/MMS). This form explains how our text communications work, asks for your voluntary consent, and outlines the implications of opting in.

2. What We May Text You About

If you opt in, you may receive texts related to your employment, including:

  • Shift scheduling, changes, coverage requests, and reminders;
  • Time-sensitive operational updates (studio access, client arrivals, session changes);
  • Day-of logistics for sessions, events, and shoots;
  • Company announcements, meetings, and training reminders;
  • Safety, weather, or facility alerts;
  • Requests to acknowledge or respond to work communications.

These messages may be sent by owners, managers, team members, or an automated scheduling or messaging platform on our behalf.

3. Voluntary Consent

Opting in to text communications is voluntary. You may decline to opt in, and your decision will not negatively affect your employment status. If you do not opt in, we will communicate with you through other channels (email, phone calls, in-person, or our scheduling platform).

4. Implications of Opting In

By opting in to employer text communications, you understand and agree that:

  • Messages may arrive outside scheduled work hours. Work-related texts may be sent before, during, or after your scheduled shifts, including evenings and weekends. You are not required to respond to work-related texts outside your scheduled working time unless you are on call or otherwise compensated to do so in accordance with applicable wage-and-hour laws.
  • Non-exempt (hourly) employees: If you are a non-exempt employee and you perform work in response to a text (for example, responding to work questions, reviewing documents, covering a shift call-out, or traveling to cover a shift), that time is compensable working time. You must accurately record that time on your timesheet. Do not perform off-the-clock work. If you are unsure whether an activity counts as work time, ask your manager before responding.
  • Message and data rates may apply from your mobile carrier. We do not reimburse personal mobile phone or data charges unless required by law or specifically agreed in writing.
  • Personal device, personal number. If you use your personal cell phone, your personal mobile number will be used for these messages. Coworkers and managers who are part of a group thread or scheduling platform may see your number.
  • Confidentiality. Text messages are not a secure channel. Do not send or request confidential personnel information, medical information, payment information, passwords, client personally identifiable information, or other sensitive data by text. Use approved channels for those discussions.
  • Professional conduct. All company policies, including anti-harassment, non-discrimination, confidentiality, social media, and acceptable use policies, apply to text communications the same as any other work communication.
  • Records. Work-related text messages may be considered business records and may be retained, reviewed, and used by Electric Photoland consistent with applicable law, including in the event of an investigation or legal matter.
  • No expectation of privacy in the content of work-related texts sent or received on any device (personal or company-issued), to the extent permitted by law. This does not give Electric Photoland a right to access your personal messages or device beyond the work-related communications you send or receive.
  • Message frequency varies. The number of messages you receive will vary depending on business needs, your role, and scheduling activity. There is no fixed number of messages per week or month. This is a recurring message program.
  • Help. Reply HELP to any of our text messages for assistance, or contact us at smile@electricphotoland.co or (509) 240-9000 for support with our text messaging program.
  • Opt-out. Reply STOP to any of our text messages to opt out. After you reply STOP, you will receive one final confirmation message, and you will no longer receive any further text messages from Electric Photoland unless you re-enroll. You may also opt out by contacting us at smile@electricphotoland.co.

5. Opting Out / Withdrawing Consent

You may withdraw your consent and stop receiving text messages at any time by:

  • Replying STOP to any text message from Electric Photoland. You will receive a single confirmation message stating: "You have been unsubscribed from Electric Photoland text messages. You will not receive any further messages. Reply HELP for help or contact smile@electricphotoland.co." After that confirmation, you will not receive any further text messages from Electric Photoland unless you choose to re-enroll.
  • Notifying your manager or HR in writing (email is acceptable) at smile@electricphotoland.co.

After you opt out, we will communicate with you about work matters through alternative channels. Opting out does not relieve you of any job responsibilities, nor does it affect your employment status.

6. If Your Number Changes

You agree to promptly notify Electric Photoland if your mobile number changes, if you lose your device, or if you no longer control the number you provided, so we can update our records and avoid sending work texts to an unintended recipient.

7. Acknowledgment and Consent

I have read and understand this Employee Text Message Consent and Acknowledgment. I understand that providing consent is voluntary and that I can withdraw it at any time. I understand the implications described above, including my obligation, if I am a non-exempt employee, to accurately record any work time spent in response to texts.
